1. Affordable Housing - Not less than 40% of the total number of dwellings 75% to be rented 25% to be shared ownership. Not more than 50% of the OMD shall be occupied until the Council is satisfied that secure arrangements are in place with an RSL.
Not more that 50% OMD shall be occupied until construction is completed of 75% of the affordable dwellings such that they are ready for occupation.
Not more than 95% of OMD shall be occupied until construction completed on the remaining 25% of affordable units.

2. Public Open Space - Not to occupy more than 50% of total number of dwellings until work has commenced pn the POS
The On-Site POS shall comprise Green Flag Park Standard public park and public gardens and landscaped areas including the cycleway/footpath.
The On-Site POS shall be contamination free to the reasonable satisfaction of the Council's CEHO.
Not to develop the On-Site or any part thereof for any purpose whatsoever other than recreational purposes and the erection of buildings and equipment ancillary to such use and to retain the On-Site POS in perpetuity as open space for the enjoyment of the general public.
To transfer the On-Site POS upon expiry of the maintenance period for nil consideration, and to pay commuted sum to be held by the Council for maintenance of the POS.
Not to occupy more than 50% of the total number of dwellings until it has paid the Off-Site POS contribution to the Council.
3. Highways - Not to occupy more than 50% of the total number of dwellings until the Highway contribution has been paid:
a) £150,000 towards the improvements to the Newbold Road/Wood Street Junction.
b) £1,000 towards traffic survey work in the vicinity of the property and
c) £15,000 towards improvements to the Black Path National Cycleway Network Route.
4. Education - Prior to 50% of the dwelling being occupied to pay education contribution of £349,216 (based on 125 dwellings) towards the cost of expanding, improving, providing or altering educational facilities within a 3 mile radius of the development.
In the event that the number of dwellings changes from 125 then the Education formula shall apply for Early Years, Secondary and Sixth Form School Contributions.
5. Library - Not to occupy more than 100 dwellings until it has paid the Library Contribution of £29,229.

1. Affordable Housing - Not to commence development until the applicant has identified and obtained the approval of the Council to the size type location, number and mix of dwellings to be made available on development as Affordable Housing and the phasing of the construction of the affordable housing. Not less than 40% of the total number of dwellings shall be provided as affordable dwellings comprising rented affordable housing units and shared ownership units. (See agreement for further details).
2. Public Open Space and Play Equipment (On-site) - Not to commence development until it has identified and submitted to the Council and obtained the approval of the Council to the location, layout and design details of the On-site POS. Not to occupy more than 50% of the total number of dwellings until it has commenced work on the On-site POS. For details see copy of the Agreement. Upon expiry of the Maintenance period, the applicant shall pay to the Council the sum of £37,400 subject to indexation for maintenance of the On-site POS.
3. Public Open Space (Off-site) - Not to occupy more than 50% of the total number of dwellings on the site until it has paid to the Council the sum of £50,000 subject to indexation as contribution towards the provision of POS and play equipment in the vicinity of the development. (5 Year repayment clause).
4. Highways, Public Transport & Travel Plan - Not to occupy more than 50% of the total number of dwellings until a contribution of £150,000 has been made to the County towards improvements and any other work in the local vicinity of Newbold Road / Wood Street junction that the highways Authority deems necessary. £1,000 towards traffic survey work in the vicinity of the property and £15,000 towards improvements to the Black Path National Cycleway Network Route. 5 Year Repayment clause.
5. Education - Not to occupy more than 50% of the total number of relevant dwellings until it has paid to the County the Education Contribution of £259,345 being the sum calculated at 98 dwellings. 5 year repayment clause.
6. Library - Not to occupy more than 100 dwellings until it has paid to the County a contribution of £13,370 towards the cost of additional facilities at Rugby Library. 5 Year repayment clause.
Newbold Farm, Main Street, Newbold, Rugby. Section 106 dated 16/11/2009.
1. Affordable Housing - Prior to commencement of development of the eighth private housing unit, the Applicant shall commence construction of the 4 Rented Affordable Housing Units, such units to be offered for Low Cost Rental as defined in s69 of the 2008 Act. No more than 7 of the private Housing Units shall be occupied until all the Affordable Housing Units have been constructed and made ready for residential occupation and written notification of such has been received by the Council. Prior to Commencement of Development of the eighth Private Housing Unit, the Applicant shall commence construction of the 1 Shared Ownership Unit, to be disposed of by way of low cost home ownership as defined in s70 of the 2008 Act. 2. Public Open Space - Within 7 days of commencement of development the Applicant shall pay to the Council the sum of £13,750 and applied by the Council for the enhancement, improvement and future maintenance of POS and recreation facilities within the vicinity of the Development at the discretion of the Council. ( repayable after 5 years)
3. Library - Within 7 days of Commencement of the Development the Applicant shall pay to the County the sum of £2,820 (subject to Indexation) by way of a contribution towards the cost of providing additional Library facilities within the locality of the Development. ( repayable after 5 years)
4. Education - Within 7 days of Commencement of Development the Applicant shall pay to the County the sum of £31,380 (subject to Indexation) by way of a contribution towards the cost of improving, altering and expanding the educational facilities within 3 miles of the development. (Repayable after 5 years).
